Service Availability

We strive to ensure that the Service is available 24 hours a day, 7 days a week. However, we do not guarantee that the Service will be available at all times, and no uptime SLA is offered on consumer plans. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors.

We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Service at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Service during any downtime or discontinuance of the Service.

Service Limitations

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

You understand that PAMKIT uses third-party vendors and hosting partners (including Supabase for authentication and database services, Stripe for payment processing, and AWS Amplify for hosting) to provide the necessary hardware, software, networking, storage, and related technology required to run the Service. We are not responsible for any failures attributable to third parties.

Your Responsibility for Your Data

You are responsible for the accuracy, completeness and legality of everything you put into the Service, including documents, values, dates, financial entries and tenant records, and for reviewing and correcting anything the Service extracts or generates on your behalf. The Service is a convenience layer over your own records; it is not a system of record, a legal archive or a backup service. Keep your own independent copies of anything you cannot afford to lose. Export tools are available in Settings at any time. We maintain backups for our own operational continuity, but we do not guarantee that any particular file, version or entry can be recovered.

Beta & Experimental Features

We may label features as beta, preview, early access or experimental, and we may offer them to a subset of users. Beta features are provided as is, for evaluation, and are excluded from every commitment elsewhere in these Terms, including availability, support and data durability. They may change, break, lose data or be withdrawn at any time without notice. Do not use a beta feature for anything you cannot afford to lose or redo, and export anything important before relying on it. Any feedback you give about a beta feature is covered by the feedback license section of these Terms. Pricing for a beta feature may change when it becomes generally available.

Third-Party Service Providers

The Service may show third-party service providers, contractors, vendors, insurers and other businesses, including results drawn from third-party directories and mapping data. We do not vet, license, bond, insure, endorse, recommend or supervise them, and listings, ratings, availability and contact details may be inaccurate or out of date. Any engagement you enter with a provider is solely between you and that provider. PAMKIT is not a party to it, earns no role in it, and is not responsible for the quality, timeliness, safety, legality or pricing of their work or for any loss, injury or damage arising from it. Verify licensing and insurance yourself before hiring anyone.

User Conduct

By using the Service, you agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Violate or encourage others to violate the rights of third parties, including intellectual property rights
  • Upload or transmit viruses, malware, or other types of malicious software, or any content that may damage or disrupt the Service
  • Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks
  • Collect or harvest any information from the Service, including user accounts
  • Impersonate another person or entity or misrepresent your affiliation with a person or entity
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use any robot, spider, or other automated device, process, or means to access the Service for any purpose
  • Introduce any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm us or users of the Service or expose them to liability

We reserve the right to terminate your access to the Service immediately, without prior notice, if in our sole discretion you violate any of the terms or conditions of these Terms.

Intellectual Property

Service Content

The Service and its original content, features, and functionality are and will remain the exclusive property of PAMKIT and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PAMKIT.

User Content

You keep all rights to your content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, reformat and create technical derivatives of your content solely to operate, secure and improve the Service for you, including processing it through our AI providers and generating backups. This license ends when you delete the content or close your account, except for copies retained in backups or archives as described in our Privacy Policy. You represent that you own or are licensed to upload your content, and that where it contains another person's personal information — such as a tenant, family member or advisor — you have the authority to provide it to us.

You further represent and warrant that the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

Feedback License

If you send us suggestions, feature requests, bug reports, survey answers or other feedback about the Service, you grant Kollitech Corp. a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, copy, modify and incorporate that feedback into our products without restriction, attribution or compensation. You agree that feedback is not confidential, that we may already be working on the same idea, and that we have no obligation to act on it, keep it private, or return it. Do not send us anything you consider confidential or that you are not free to share.

Payment Terms

Subscription Plans

PAMKIT offers various subscription plans, including:

  • Free Plan: Free forever with unlimited asset, appliance, and document tracking (1 GB document storage)
  • Pro Plan: Premium features for individual users
  • Family Plan: Premium features for families with enhanced sharing capabilities

By selecting a paid subscription plan, you agree to pay the subscription fees indicated for that service. All users registered before March 31, 2026, receive free access until that date. Grandfathered users (registered before March 31, 2026) receive 1 year of free subscription. Users registered between March 31, 2026 and April 21, 2026 received a 90-day free trial and retain it until their original end date. Users registered between April 22, 2026 and August 22, 2026 received a 14-day free trial and retain their original trial terms. New users registered on or after August 23, 2026 receive a 45-day free trial of paid plans with no payment method required; at the end of the trial, accounts without a paid subscription continue on the Free plan.

Billing Cycle

Subscription fees are billed in advance on a monthly or annual basis depending on the type of subscription plan you select. If you select an annual plan, you will be charged the annual rate each year on the same date that you subscribed.

Automatic Renewal

Paid subscriptions renew automatically until you cancel. When you subscribe, we show you the renewal terms before you pay: the plan, the price, how often you will be charged, that the subscription continues to renew at that price and interval until you cancel, and how to cancel. We ask you to agree to those renewal terms separately from these Terms, using a box that is not pre-checked. Pro is $8.99 per month or $59.99 per year; Family is $19.99 per month or $149.99 per year. At the end of each billing period your subscription renews for another period of the same length at the then-current price, and you authorize us to charge the payment method we have on record for you. Current prices and your own renewal date are shown at checkout and in Settings > Billing. We email you a receipt for every charge.

How to cancel. You may cancel at any time, without charge, without giving a reason, and without speaking to anyone. Cancellation is available in the same place you subscribed:

  • Bought on our website: cancel in Settings > Billing, which opens your billing portal in one click. Cancellation takes effect immediately on request; you keep access until the end of the paid term and are not charged again.

Bought on our website:

  • Bought in our iOS app through Apple: Apple, not PAMKIT, processes and manages your subscription. Cancel in your Apple account at Settings > [your name] > Subscriptions, or at apps.apple.com/account/subscriptions. We cannot cancel an Apple subscription for you.

Bought in our iOS app through Apple:

If you tell us you want to cancel a subscription we cannot cancel ourselves, we will tell you exactly where to do it and will not try to talk you out of it first. You can also reach us at support@pamkit.net for help, but you never have to contact us in order to cancel.

Free Trials and Promotional Periods

We may, at our sole discretion, offer subscriptions with free trials or promotional periods. We do not ask for a credit card to start the 45-day free trial available to accounts registered on or after August 23, 2026, and we do not keep a card on file for those trials. When that trial ends, nothing is charged: your account simply continues on the Free plan unless you choose a paid plan and complete checkout yourself.

If a trial you were offered did require a payment method, we will charge the applicable subscription fee at the end of that trial unless you cancel first. You can see your trial end date and cancel at any time in Settings > Billing.

Fee Changes

We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. We will give existing subscribers clear and conspicuous notice by email at least 30 days before any price increase takes effect, and that notice will tell you the new price, when it starts, and how to cancel. Price decreases may take effect immediately. If you do not agree to a price increase, you may cancel your subscription before the increase takes effect.

Refunds

Where you bought your subscription decides who can refund it.

  • Bought on our website (processed by Stripe): we review refund requests case by case. Ask in Settings > Billing > Request Refund, or email support@pamkit.net with your account details and the reason. We generally do not refund partial periods, but we may make exceptions.

Bought on our website (processed by Stripe):

  • Bought through Apple: Apple is the seller of record for those purchases and controls refunds. We cannot issue, approve or speed up a refund for an in-app purchase. Request an Apple refund at reportaproblem.apple.com. If you ask us, we will point you to the right place and, where the store allows it, tell the store we do not object.

Bought through Apple:

Whatever this policy says, if we charged you when we should not have, we refund it. That includes a charge after you cancelled, a renewal we failed to give you the notice we promised, and a price increase we did not tell you about in time.

None of this affects any refund right you have under the law where you live, or your right to dispute a charge with your card issuer or bank.

Payment Methods

We accept major credit cards, debit cards, and other payment methods as displayed during checkout. All payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you represent and warrant that you are authorized to use the payment method provided.

App Store Terms

If you obtained a PAMKIT app from the Apple App Store or Google Play, you also agree to that store's terms. This agreement is between you and Kollitech Corp. only, not with Apple or Google. Apple and Google have no obligation to provide support or maintenance for the app and no responsibility for any claim about it, including product liability, legal or regulatory non-compliance, or intellectual property claims. Apple and Google are third-party beneficiaries of this section and may enforce it. Purchases made inside an app are processed by the store, and refunds for those purchases are handled under the store's policies, not ours. You represent that you are not located in a US-embargoed country.

Referral Program

Referral credits and rewards are promotional, have no cash value, are not transferable or redeemable for money, and may be changed, limited or discontinued at any time. A referral qualifies only when the person you referred creates a new account that we have not seen before, using your link, and keeps it in good standing for any qualifying period stated on the offer. Self-referrals, duplicate or automated signups, purchased traffic, spam, paid search on our brand terms and any misrepresentation of PAMKIT disqualify the referral and may cost you your credits and your account. We decide eligibility, and unused credits expire when your account closes.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PAMKIT AND KOLLITECH CORP. EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

PAMKIT MAKES NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS; (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; OR (V) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

PAMKIT MAKES NO WARRANTY THAT AI-GENERATED CONTENT, RECOMMENDATIONS, INSIGHTS, FORECASTS, OR ANALYSES PROVIDED THROUGH THE SERVICE (INCLUDING THOSE POWERED BY GOOGLE GEMINI, XAI GROK, OPENAI, AND ANTHROPIC CLAUDE, ACCESSED ONLY THROUGH PAMKIT'S SERVER-SIDE PROXY, OR OTHER AI PROVIDERS WE MAY USE FROM TIME TO TIME) WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR PURPOSE. AI OUTPUTS MAY CONTAIN ERRORS, OMISSIONS, OR INACCURACIES. YOU ACKNOWLEDGE THAT AI TECHNOLOGY IS INHERENTLY PROBABILISTIC AND THAT RESULTS MAY VARY.

PAMKIT makes no warranty about the accuracy of optical character recognition, document parsing, field extraction, barcode or label recognition, bill and transaction categorization, subscription detection, property or asset valuation, or warranty and expiration date detection. Extracted values may be wrong, transposed, assigned to the wrong asset, or missing, and automated reminders may fire late or not at all. You are responsible for reviewing every extracted field and every reminder, and for meeting your own deadlines, including warranty claim windows, insurance renewals, lease notice dates and tax filings. Do not rely on the Service as your only reminder for a deadline that matters.

Not Professional Advice

The Service is not a substitute for professional financial, legal, tax, accounting, or investment advice. PAMKIT provides AI-powered tools and information for personal asset management purposes only. You should always consult with qualified professionals before making financial, legal, or tax decisions. Any information, insights, recommendations, or analytics provided through the Service are for informational purposes only and do not constitute professional advice of any kind.

PAMKIT does not act as a financial advisor, tax advisor, legal counsel, insurance broker, or real estate agent. We are not registered with the SEC, FINRA, or any other financial regulatory body as an investment advisor. You should not rely solely on the Service for any decision that could have financial, legal, or tax implications.

PAMKIT is not your fiduciary, broker, agent, adviser or financial institution, and nothing in the Service creates a fiduciary, agency or advisory duty to you. When you link a bank account, you do so through Stripe Financial Connections and the account is read-only: PAMKIT cannot move money, initiate payments or transact on your behalf. Balances, transactions, categorizations, subscription detections and anomaly flags are informational, may be delayed, incomplete or mismatched, and are not a substitute for your bank or card statements. Your bank's records control. Review your own statements, and report errors to your financial institution within the windows its agreement requires.

Third-Party Services

The Service integrates with third-party services including but not limited to Supabase (authentication and database), Stripe (payment processing), AWS Amplify (hosting), and various AI providers, currently Google (Gemini), Anthropic (Claude), xAI (Grok) and OpenAI. Our current, authoritative list of sub-processors is maintained in the Sub-Processors section of the Privacy Policy. We do not warrant or guarantee the availability, accuracy, or reliability of any third-party service. Your use of third-party services is subject to the terms and conditions of those respective providers.

Limitation of Liability

In no event shall PAMKIT, Kollitech Corp., nor their directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; (iv) unauthorized access, use or alteration of your transmissions or content; (v) errors or inaccuracies in AI-generated content or recommendations; (vi) failures or delays in AI processing; or (vii) any decisions made based on AI-generated insights, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

To the maximum extent permitted by applicable law, the total liability of PAMKIT and Kollitech Corp. for all claims arising out of or relating to the use of the Service shall not exceed the amount you paid to PAMKIT during the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

The limitations in this section apply to every claim arising from data loss, data corruption, unauthorized access to or disclosure of your content, failure or delay of a backup or restore, and any decision made using AI output, regardless of the legal theory. Our total liability for all such claims is subject to the cap above. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, or gross negligence. If applicable law does not permit the exclusion of a particular category of damages, our liability for that category is limited to the minimum the law allows.

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Kollitech Corp., PAMKIT, and their officers, directors, employees, agents, licensors, suppliers, and any third-party information providers from and against all losses, expenses, damages, costs, claims, and demands, including reasonable attorneys' fees, arising out of or related to:

  • Your use of the Service or any activity occurring under your account
  • Your violation of these Terms or any applicable law or regulation
  • Your violation of any rights of a third party, including but not limited to intellectual property rights, privacy rights, or publicity rights
  • Any content you submit, post, or transmit through the Service
  • Your negligent or wrongful conduct

Kollitech Corp. reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Kollitech Corp. in asserting any available defenses. You agree not to settle any matter without the prior written consent of Kollitech Corp. This indemnification obligation will survive the termination of these Terms and your use of the Service.

Termination

Termination by You

You may terminate your account at any time by accessing your account settings and selecting the account deletion option, or by contacting us at support@pamkit.net. Account deletion follows a 30-day grace period during which you may cancel the deletion and recover your account and all associated data. After the 30-day grace period, your account and data will be permanently deleted. Upon termination:

  • A 30-day grace period begins, during which your account is deactivated but your data is preserved
  • You may cancel the deletion at any time during the grace period to restore full access
  • After the grace period, your right to access and use the Service will permanently cease
  • Any active subscriptions will be canceled, and you will not be charged for future billing periods
  • You may request a copy of your data before or during the grace period (subject to our data retention policies)

Termination by PAMKIT

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms or our Privacy Policy
  • Fraudulent, abusive, or illegal activity
  • Non-payment of subscription fees (after a grace period)
  • Extended periods of account inactivity (as defined in our policies)
  • Violation of applicable laws or regulations

Effect of Termination

Upon termination of your account:

  • All licenses and rights granted to you under these Terms will immediately terminate
  • We may delete or anonymize your account data in accordance with our data retention policies
  • You remain responsible for any fees or charges incurred prior to termination
  • Provisions of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property rights, disclaimers, indemnification, limitation of liability, and dispute resolution provisions

Data Retention After Termination

After account termination, we may retain your data for a reasonable period as required by law, for legitimate business purposes, or to resolve disputes. We will delete or anonymize your personal data in accordance with our Privacy Policy and applicable data protection laws. Archived messages and certain transaction records may be retained longer for regulatory compliance purposes as described in our Message Archival Policy.

AI and Machine Learning

AI-Powered Features

PAMKIT uses artificial intelligence and machine learning technologies to provide intelligent features including document categorization, natural language search, predictive analytics, automated reminders, and personalized insights. By using the Service, you acknowledge and agree to the use of AI technologies as described herein.

Data Used for AI Processing

To provide AI-powered features, we process your data including:

  • Document content and metadata for OCR and categorization
  • Asset information for valuation and tracking
  • Financial data for analytics and forecasting
  • Usage patterns to improve AI accuracy and personalization

AI Accuracy and Limitations

AI features produce estimates, not determinations. Categorizations, extracted fields, valuations, forecasts, insights, lease drafts, tax suggestions, insurance observations and maintenance predictions may be incomplete, outdated or simply wrong. They are not legal, tax, accounting, financial, investment, insurance, real estate or engineering advice, and no output creates a professional relationship with you. You must independently verify any AI output before relying on it, and you must consult a qualified licensed professional before any decision with legal, financial, tax or insurance consequences. You are solely responsible for decisions you make using the Service, and PAMKIT is not liable for them.

Third-Party AI Services

PAMKIT may use third-party AI services, currently Google (Gemini), Anthropic (Claude), xAI (Grok) and OpenAI, to power certain features. Your data may be processed by these third-party services in accordance with their privacy policies and our data processing agreements. Our current list is maintained in the Sub-Processors section of the Privacy Policy, which is the authoritative list. We ensure all third-party AI providers meet our security and privacy standards.

Opt-Out of AI Features

You may disable certain AI features through your account settings. However, disabling AI features may limit the functionality of the Service. Some core features of PAMKIT rely on AI processing and cannot be disabled.

Rental & Tenant Application Tools

The Rental Center, lease generator and tenant application tools are record-keeping and document-drafting aids. PAMKIT is not a consumer reporting agency, does not furnish consumer reports, and does not obtain credit reports, criminal histories or background checks. Any score or recommendation shown is calculated from information the applicant supplied and must not be used as a consumer report or as the sole basis for a tenancy decision. You are solely responsible for complying with the Fair Housing Act, the Fair Credit Reporting Act, state and local landlord-tenant law, rent control, security-deposit limits, required disclosures and notice periods. Lease drafts are templates, not legal advice. Have a licensed attorney in your jurisdiction review any lease before you use it.

The Application Summary is generated only from what the applicant submits in their application to you. PAMKIT does not obtain, purchase, receive or store consumer reports, credit reports, criminal history records or eviction records from any source, and does not make the Application Summary available to any landlord other than the one the applicant applied to. If we ever change this, we will tell you before we do, and we will comply with the Fair Credit Reporting Act if it applies to the changed service.

If you run your own screening. If you obtain a consumer report about an applicant yourself, you, not PAMKIT, are the user of that report. For a rental application the Fair Credit Reporting Act permissible-purpose provisions are 15 U.S.C. section 1681b(a)(2) (the written instructions of the consumer) and section 1681b(a)(3)(F) (a legitimate business need in connection with a business transaction initiated by the consumer). Section 1681b(b), which carries the standalone-disclosure and certification formalities, applies to employment screening and does not govern tenant screening. If you take an adverse action based in whole or in part on a consumer report, section 1681m requires you to give the applicant notice identifying the consumer reporting agency, stating that the agency did not make the decision, and telling the applicant of their right to a free copy of the report and to dispute its accuracy.

California screening fees. If your property is in California, AB 2493 (effective January 1, 2025) requires you either to use a first-qualified-applicant process or to refund application screening fees to applicants you do not select, and to give an applicant a copy of any consumer report you obtained about them within seven days. PAMKIT does not do either of these for you.

Solar Monitoring

Solar monitoring is read-only and is for your own system. It reads data from a solar monitoring gateway you own, on your own home network, and never controls inverters, batteries or any other equipment. Do not connect a system you do not own or have the owner's permission to monitor. Savings and other dollar figures are estimates based on the utility rate you choose; they are not guaranteed and are not a bill, quote or tax advice.

DMCA / Copyright Policy

Digital Millennium Copyright Act (DMCA) Notice

PAMKIT respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the Service if such claims are reported to our designated copyright agent.

  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

DMCA notices should be sent to our designated copyright agent at:

Email: legal@pamkit.net Mail: Kollitech Corp., Attn: DMCA Agent, 1160 Battery Street East, Suite #100, San Francisco, CA 94111

  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled
  • A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in San Francisco, California, and that you will accept service of process from the person who provided the original DMCA notification

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action within ten (10) business days of receiving the counter-notification, we may restore the removed content.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, PAMKIT has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Safe Harbor

PAMKIT claims the protection of the safe harbor provisions of the DMCA (17 U.S.C. Section 512) with respect to user-generated content hosted on the Service.

Export Compliance

The Service and its underlying technology may be subject to United States export control laws, including the U.S. Export Administration Regulations ("EAR"), and economic sanctions administered by the Office of Foreign Assets Control ("OFAC") of the U.S. Department of the Treasury.

By accessing or using the Service, you represent and warrant that:

  • You are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions
  • You are not identified on any U.S. government list of prohibited or restricted parties, including the Specially Designated Nationals and Blocked Persons List ("SDN List"), the Sectoral Sanctions Identifications List, the Entity List, or the Denied Persons List
  • You will not use the Service for any purposes prohibited by U.S. law, including the development, design, manufacture, or production of nuclear, missile, chemical, or biological weapons or any other weapons of mass destruction
  • You will not export, re-export, or transfer any portion of the Service or any related technical information or materials, directly or indirectly, in violation of any applicable export laws or regulations

You agree to comply with all applicable export laws and regulations. Any violation of these export compliance provisions may result in immediate termination of your access to the Service.

Force Majeure

Neither PAMKIT, Kollitech Corp., nor you shall be liable for any failure or delay in performing any obligation under these Terms where such failure or delay results from any cause that is beyond the reasonable control of the affected party, including but not limited to:

  • Acts of God, natural disasters (earthquakes, floods, hurricanes, wildfires), or severe weather events
  • War, armed conflict, terrorism, riots, insurrection, or civil unrest
  • Epidemics, pandemics, or public health emergencies
  • Government actions, sanctions, embargoes, laws, regulations, or orders
  • Internet service disruptions, telecommunications failures, or network outages
  • Power outages, electrical grid failures, or infrastructure failures
  • Cyberattacks, distributed denial-of-service (DDoS) attacks, or other malicious interference
  • Failure or disruption of third-party services, including cloud hosting providers, payment processors, or AI service providers
  • Strikes, labor disputes, or work stoppages

The affected party shall give prompt notice to the other party of the force majeure event and shall use commercially reasonable efforts to mitigate the effects of the force majeure event and resume performance of its obligations as soon as reasonably practicable. If the force majeure event continues for a period exceeding ninety (90) days, either party may terminate these Terms upon written notice to the other party.

Electronic Communications Consent

By creating an account or using the Service, you consent to receive electronic communications from PAMKIT, including but not limited to:

  • Account-related emails (registration confirmation, password resets, security alerts)
  • Service notifications (subscription updates, billing confirmations, feature changes)
  • Legal notices (changes to Terms of Service, Privacy Policy updates)
  • Transactional emails related to your use of the Service

You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This consent applies to all communications from PAMKIT, including those required by federal, state, or local law.

Keeping Your Email Current: You are responsible for keeping your email address on file with PAMKIT current and accurate. If your email address changes, you must update it promptly in your account settings. PAMKIT is not responsible for any failure to deliver communications due to an outdated or incorrect email address on your account.

You may withdraw your consent to receive electronic communications by closing your account. However, withdrawal of consent may limit or terminate your ability to use the Service, as certain electronic communications are essential to the operation of the Service.

SMS & Text Messaging Consent

By providing your mobile number and enabling phone verification or SMS two-factor authentication, you consent to receive automated text messages from PAMKIT at that number for verification codes, security alerts and account notices. These are transactional messages; message frequency depends on your activity. Message and data rates may apply, and delivery depends on your carrier, which is not liable for delayed or undelivered messages. Reply STOP to any message to stop texts and HELP for help; stopping texts will disable SMS-based verification on your account. You confirm you are the subscriber or authorized user of the number, and you will update it in Settings if it changes.

Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms, in whole or in part, without the prior written consent of PAMKIT. Any attempted assignment, transfer, or delegation without such consent shall be null and void.

PAMKIT may freely assign, transfer, or delegate its rights and obligations under these Terms without restriction and without notice to you, including in connection with any merger, acquisition, reorganization, sale of assets, or other corporate transaction. In the event of such an assignment, the assignee shall assume all of PAMKIT's obligations under these Terms, and these Terms shall be binding upon and inure to the benefit of the assignee.

Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties, their successors, and permitted assigns.

Severability & Waiver

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

Waiver

The failure of PAMKIT to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of PAMKIT.

Entire Agreement

These Terms of Service, together with the Privacy Policy and any other legal notices, agreements, or policies published by PAMKIT on the Service, constitute the entire agreement between you and PAMKIT concerning the Service. These Terms supersede all prior or contemporaneous communications, proposals, negotiations, understandings, and agreements, whether written or oral, between you and PAMKIT relating to the subject matter hereof.

No amendment or modification of these Terms shall be binding unless in writing and signed by an authorized representative of PAMKIT. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

Kollitech Corp. (PAMKIT) 1160 Battery Street East, Suite #100 San Francisco, CA 94111 Phone: 628-333-5116 Email: support@pamkit.net

California Consumer Privacy

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). Please refer to our Privacy Policy for detailed information about your California privacy rights, including the right to know, the right to delete, the right to correct, and the right to opt out of the sale or sharing of personal information.

California Automatic Renewal Law

If you are a California resident and you buy a subscription that renews automatically, California law (Bus. & Prof. Code sections 17600 to 17606) gives you specific rights. Before we charge you, we show you the renewal terms, the price and the billing frequency next to the button you use to subscribe, and we ask you to agree to those renewal terms separately, using a box that is not pre-checked. You may cancel online, in the same place you subscribed, at any time, and cancelling never requires you to call or email us. If we increase your price, we will tell you at least 30 days before the new price takes effect, and that notice will tell you how to cancel. See the Automatic Renewal and Refunds sections above for the details for each purchase channel.

Dispute Resolution

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@pamkit.net. We will try to resolve the dispute within 30 days of receiving your notice.

Binding Arbitration

If we cannot resolve a dispute informally, you and PAMKIT agree to resolve any claims, disputes, or controversies arising out of or relating to these Terms or the Service through final and binding arbitration, except as set forth below.

Consumer arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, which govern filing fees and hearing locations. Under those rules, any in-person hearing is held at a location reasonably convenient to both parties, and virtual hearings are the default unless the parties agree otherwise. You may also arbitrate by telephone or on written submissions alone. You are not required to travel to San Francisco, California for an arbitration hearing.

Right to Opt Out of Arbitration

You may reject this arbitration agreement by emailing legal@pamkit.net within 30 days of first accepting these Terms, stating your name and that you opt out; opting out affects nothing else in these Terms. We will confirm your opt-out by email within 30 days. If we materially change this Dispute Resolution section, you may opt out of the changed version by emailing legal@pamkit.net within 30 days after the change takes effect; if you do, the version of this section in effect before the change continues to apply to you.

Mass Filings

If 25 or more arbitration demands raising substantially similar claims are submitted against PAMKIT by or with the assistance of the same or coordinated counsel, the AAA Mass Arbitration Supplementary Rules and the AAA mass arbitration fee schedule then in effect will apply, and a process arbitrator appointed by the AAA, not PAMKIT, will decide any question about whether those rules apply and how the demands are administered. Any applicable statute of limitations, and the one-year period in the Time Limit to File Claims section of these Terms, are tolled for each claimant from the date that claimant's demand is submitted to the AAA until that claimant's demand is resolved or withdrawn.

Exceptions to Arbitration

The following are not subject to arbitration:

  • Either party may bring an individual action in small claims court for any dispute that is within the jurisdiction of that court, including where the amount in controversy is within that court's jurisdictional limit as it may change from time to time.
  • Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to preserve the status quo pending arbitration, including to prevent the actual or threatened infringement, misappropriation or violation of that party's intellectual property rights. The merits of the dispute remain subject to arbitration.

temporary or preliminary

  • Either party may bring an action before a government agency where applicable law preserves that right notwithstanding an agreement to arbitrate, including a complaint to a state attorney general or to the Federal Trade Commission.

Public Injunctive Relief

Nothing in these Terms waives your right to seek public injunctive relief. If a claim for public injunctive relief is asserted, that claim alone is severed from arbitration and stayed pending the conclusion of arbitration of all other claims; every other claim is arbitrated on an individual basis. This paragraph may not be severed, and if it is held unenforceable, the entire agreement to arbitrate in this section is void.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and PAMKIT each waive any right to a jury trial. If the class-action waiver in this section is held unenforceable, that claim proceeds in court and the rest of this section still applies.

Time Limit to File Claims

Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose. A claim not filed within that period is permanently barred. Where applicable law does not permit shortening the limitations period for your claim, the shortest period that law allows applies instead.

This paragraph does not apply to any claim under the California Unfair Competition Law, the California Consumers Legal Remedies Act, the federal Fair Credit Reporting Act, or any other claim for which applicable law does not permit the limitations period to be shortened by agreement, and it does not shorten any period you have to dispute a charge with your card issuer, bank or app store.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Jurisdiction: For any dispute not subject to arbitration under the Dispute Resolution section, and for any action to enforce an arbitration award, the state and federal courts located in San Francisco County, California have jurisdiction, and each party consents to personal jurisdiction there. This does not limit your right to bring an individual action in the small claims court of the county where you live, and it does not override any right you have under applicable law to bring an action in the courts of your home state.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. For material changes we will give at least 30 days' notice by email or in-app notification before they take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Message Archival and Data Retention

Message Archival Policy

PAMKIT implements a comprehensive message archival system to ensure regulatory compliance and maintain a complete audit trail of all communications. When you delete a message through the Service, the message is not permanently removed from our systems. Instead, it is archived in a secure database maintained for regulatory, legal, and compliance purposes.

What Happens When You Delete a Message

When you choose to delete a message:

  • The message is immediately removed from your view and the view of all other participants in the conversation
  • A copy of the message, including its content, timestamp, and metadata, is automatically stored in our secure message archive
  • The archived message includes information about who deleted it and when it was deleted
  • The message is no longer accessible through the regular messaging interface

Data Retention Period

Archived messages are retained in accordance with the Data Retention section of our Privacy Policy, which is the authoritative schedule for how long archived messages and other account data are kept. We do not restate those periods here so that this section and the Privacy Policy cannot fall out of sync. Retention may also be extended for eDiscovery, litigation hold, or other legal obligations as described below.

Access to Archived Messages

Archived messages are not accessible to regular users through the Service interface. Access to archived messages is restricted to:

  • System administrators for compliance and audit purposes
  • Authorized personnel responding to valid legal requests (subpoenas, court orders, etc.)
  • Compliance officers conducting regulatory audits
  • You, upon written request, subject to verification of identity and legal requirements

Legal Hold

In certain circumstances, such as pending litigation or regulatory investigations, we may place a "legal hold" on archived messages to prevent their deletion, even after the standard retention period expires. During a legal hold, archived messages cannot be permanently deleted until the hold is lifted.

Your Rights Regarding Archived Messages

Depending on your jurisdiction, you may have certain rights regarding archived messages, including:

  • Right to Access: You may request access to archived messages associated with your account
  • Right to Correction: You may request correction of inaccurate metadata associated with archived messages

Right to Correction:

  • Right to Erasure: In some jurisdictions (such as under GDPR), you may request permanent deletion of archived messages, subject to legal and regulatory exceptions
  • Right to Data Portability: You may request a copy of your archived messages in a structured, machine-readable format

Right to Data Portability:

To exercise any of these rights, please contact us at privacy@pamkit.net or support@pamkit.net.

Security of Archived Messages

All archived messages are stored in secure, encrypted databases with strict access controls. We implement industry-standard security measures to protect archived messages from unauthorized access, disclosure, alteration, or destruction. These measures include:

  • Encryption at rest and in transit
  • Multi-factor authentication for administrative access
  • Regular security audits and monitoring
  • Access logging and audit trails
  • Role-based access control (RBAC)

Data Breach Notification

In the event of a data breach that affects archived messages, we will notify affected users in accordance with applicable laws and regulations. We will provide information about the nature of the breach, the data affected, and steps we are taking to address the situation.

Third-Party Requests

We may disclose archived messages in response to lawful requests from public authorities, including to meet national security or law enforcement requirements. We will only disclose archived messages when legally required to do so and will provide notice to affected users unless prohibited by law.

Acknowledgment and Consent

By using the messaging features of the Service, you acknowledge and agree to this message archival policy. You understand that deleted messages are not permanently erased but are instead archived for regulatory compliance and legal purposes. If you do not agree to this policy, please do not use the messaging features of the Service.
